Commute By Bike Giveaway Contest Official Rules
This contest is designed to encourage current and potential cyclists to submit writing entries that describe personal bicycle riding experiences and thoughts on bike commuting (each, an “Entry”, collectively “Entries”). The term “Entrant” as used in these Official Rules refers to each eligible Individual that submits an Entry. Prizes will be awarded to Entrants who submit the best Entries as determined by the judges in accordance with these Rules.
This Contest is open to individuals (“Individual”) in which all Entrants: Are legal residents of the New York City; Are of legal age(18y.o and older) as of the date of Entry; Are able to ride a bicycle; Are able to come to Mr. C’s Cycles (4622 7th Avenue) in Brooklyn, NY to pick up their new commuter bicycle; Are able to provide written content and social media posts that relate to commuting by bicycle; May participate with only one written entry; In the event that an Individual does not meet the eligibility requirements set forth in these Rules the Individual will be disqualified.
3. CONTEST PERIOD
The Contest begins May 2nd, 2016 at 12:01 p.m. (EST) and will end on May 13th, 2016 at 11:59 p.m. (EST) (the “Contest Period”). Entries submitted prior to or after the Contest Period will not be accepted. Limit one Entry per Individual.
4. ENTRY REQUIREMENTS
1. All Entries must provide an answer of all required contest questions; 2. Entrants are encouraged to post Entries as early as possible – Your Entry must include ALL of the following to be considered eligible: Your written and original work detailing how you feel about commuting by bike and your most vivid bicycling memory; 3. All Entries must be in English; 4. Entries must not contain materials that are lewd, obscene, sexually explicit, pornographic, disparaging, defamatory, libelous or Entries that otherwise contain inappropriate content or objectionable material. Entries fitting any of these categories may be disqualified at any time in the Sponsor’s sole and unfettered discretion; 5. The Entry must be the Individual’s original work and must not infringe upon the copyright, trademark, patent, privacy, publicity or other intellectual property rights of any person or entity; 6. All Entries must be submitted through the following website: (www.getwomencycling.com/bike-commute-contest2016/) ; 7. The Sponsor reserves the right to at any time disqualify an Entrant who, in its sole discretion, believes has attempted to undermine the legitimate operation of the Contest, has tampered with the Contest or with any Entry or abuses, threatens or harasses other Entrants or the Sponsor. 8. All Entrants agree to follow and abide by the written requirements and judging criteria; 9. Participation in this Contest constitutes an agreement by each Entrant to be bound by these Rules and by the decision of the judges which shall be final and binding. Get Women Cycling (GWC) will not reimburse Entrants for any out-of-pocket costs incurred or for efforts expended in connection with their participation in the Contest.
Placement – For the (1) prize under Section 4, a panel of Sponsor selected judges, will review each written entry and rate each Entry on the following criteria: (i) originality and creativity, (ii) storytelling quality, (iii) inspirational content. Subject to verification of eligibility and compliance with these Rules, the entry with the highest total design score shall be awarded the Prize in accordance with these Rules. In the event of a tie at any prize level, the Entrant with the highest score in category (i) (originality and creativity) above from the tie-breaking judge will be deemed the winner.
Judges for the contest will be fully competent and are required to be fair and impartial.
The award of any prize is contingent on the potential winner (“Potential Winner”) furnishing to GWC, at an address GWC specifies, (i) fully executed documentation granting GWC an exclusive irrevocable license to use Potential Winner’s written entry in accordance with Section 7 below; and (ii) completing and signing other documentation deemed necessary by GWC at that time. Each Potential Winner must submit the aforementioned documentation within 48hr (2) days of attempted notification of winning or the Potential Winner will forfeit the prize. If a Potential Winner forfeits a prize, that prize will not be awarded with respect to such Potential Winner; the prize may be awarded to the next highest-scoring Entrant. A Potential Winner is not an official winner (“Winner”) until Potential Winner’s eligibility has been verified and the aforementioned documents documents are signed and the Potential Winner has been notified that verification is complete and documents have been signed and returned.
The following prizes will be awarded: one Fuji Cross Town 2.3 or comparable bicycle model, and additional gear, three (3) GWC individual commuter assistance sessions, and 1 year full membership to GWC. All prizes will be distributed in the form of a bicycle or additional gear as solely determined by GWC.
Sponsor reserves the right to award fewer than the number of prizes set forth herein in the event of an insufficient number of Entries meeting the criteria set forth herein. Winners will be notified by the Sponsor on or about May 14, 2016 by email at the email address provided on the entry form. The prize will be awarded on or about May 15th, 2016. The winner will be posted on getwomencycling.com on or about May 16, 2016. If any winner cannot be reached within 48hr (2) days of attempted notification, the Sponsor reserves the right to deem that prize forfeited and shall have no further obligation to such winner.
United States federal, state and local and, any provincial or foreign taxes and other obligations are solely the responsibility of the winner. Prizes may be subject to reporting for tax and other purposes. Winners agree to supply Sponsor with any information necessary for tax reporting purposes and to cooperate in fulfilling all applicable legal requirements. Providing necessary tax information and the return of required tax documents is a condition of awarding a prize to a winner. Failure to meet these requirements shall be cause for Sponsor not to award a prize.
7. LICENSES/ INTELLECTUAL PROPERTY RIGHTS/PUBLICITY RIGHTS
ENTRANTS WILL RETAIN OWNERSHIP OF THEIR ENTRIES BUT SHALL GRANT GWC AN EXCLUSIVE LICENSE TO USE THEIR ENTRIES.
All Entrants represent that all Entries submitted are entirely their own original writing, and that Entrant is the owner of all interests in and to the rights to such entry. By submitting an Entry to this contest, all Entrants further represent that there is no third party of any kind, whether an academic institution, commercial company, individual, or governmental legal entity which has any proprietary or other interest in, claims or rights to, any intellectual property rights, including trade secret, “know-how,” copyright, patent, trademark or trade name, in any entry submitted under the contest. All Entrants further represent that their Entries do not contain any confidential or proprietary information belonging to any third parties. Any Entry which Sponsor in its sole discretion believes does not comply with these requirements may be disqualified. By submitting an Entry to this Contest, all Entrants represent that there are no obligations of any nature, legal or otherwise, which would prohibit, restrict, or interfere with their participation in the Contest. All Entrants agree to obtain any necessary clearances, authorizations and/or approvals, if any, which are required as a condition of participation. No confidential relationship is established between the Sponsor and the Entrant as a result of entering this Contest. None of the information submitted by the Entrants will be treated by the Sponsor as trade secrets, confidential information, or as protected data under any obligation.
All Entrants grant the Sponsor the right to publicize their names, likeness, any biographical or other information provided on the entry form or their Entry in whatever manner without reservation or compensation. In certain countries, due to local requirements, it may be necessary for Entrants to execute, in addition to the entry form, certain other documents for license of intellectual property rights, prior to any publication of the submission. In those countries, GWC will make appropriate arrangements. Entries may be published in Sponsor or third party publications without any additional monetary or other compensation to Entrants.
If any aspect of the Contest or any rule or condition is found by a court of competent jurisdiction to be invalid, illegal or void, Entrants agree to allow the Sponsor to change such provision and, upon notice, to make it valid. Also, in such case, the remaining Contest provisions shall remain in full force and effect and the Contest shall proceed accordingly. Notwithstanding the foregoing, the contest shall be considered void where, and to the extent, it is prohibited by law.
By entering this Contest, each Entrant agrees to release and hold the Sponsor harmless from and against any losses, damages, rights, claims and actions of any kind arising from (i) an exclusion or disqualification of an Entrant pursuant to these Rules; (ii) late, lost, misdirected, or unsuccessful efforts to notify Potential Winners of any prize; (iii) forfeiture of a prize and the selection of an alternate Potential Winner; (iv) late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible Entries; (v) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures or difficulties of any kind; (vi) failed, incomplete, garbled or delayed computer transmissions; (vii) any condition caused by events beyond the Sponsor’s control that may cause the Contest to be disrupted or corrupted; and (viii) any injuries, losses or damages of any kind relating to a Contest prize, or acceptance, possession or use of the prize, or from participation in this Contest. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Contest or announcement of the prizes.The Sponsor reserves the right to cancel, terminate, modify or suspend this Contest if it becomes technically corrupted or if for any reason the Internet portion of the Contest is not capable of running as planned, including infections by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Sponsor, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest. Any attempt to deliberately damage any website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages or other remedies from any such persons responsible for the attempt to the fullest extent permitted by law.
This Contest and these Rules and Conditions shall be governed by the laws of the state of New York and Entrants agree that any dispute arising out this Contest shall be brought in the Federal District Courts in Kings County, New York City. By entering this Contest, each Entrant will be deemed to have read, accepted, and agreed to be bound by these Rules and that any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action or other proceeding.
